Home Rule Chapter 500 - Plain Township Park

WHEREAS, the Plain Township Board of Trustees has determined that Certain Township regulations are necessary and desirable to preserve the use of the Plain Township Park for all residents; and

WHEREAS, the Plain Township Board of Trustees has determined that such regulations are in furtherance of the general health, safety and welfare of Plain Township residents; and

WHEREAS, the voters of Plain Township have adopted the form of limited self-government pursuant to Chapter 504 of the Ohio Revised Code which provides that the Township may adopt resolution for the benefit of the health, safety and welfare of Township residents; and

WHEREAS, such action is not in conflict with the general law or any enumerated provision of Ohio Revised Code Section 504.04.

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plain Township Board of Trustees, Stark County, Ohio that the following resolution is adopted under Chapter 504 of the Ohio Revised Code and within the authority of limited self-government:

Section 501 - Prohibited Activities

  1. The following activity is prohibited or otherwise regulated in the Plain Township Park.
    1. No motorized vehicles in the park except in designated parking areas.
    2. No dogs on or near walking path.
    3. No roller skates, skateboards, or roller blades on walking path.
    4. All dogs must be on a leash.
    5. No bicycles except in designated areas.
    6. No alcoholic beverages.

Section 502 - Penalties

  1. The following civil fines for violation of any part of Section 501 shall be enforced by and through the Stark County Sheriff:
    1. First violation of Section 501(A) (1), (2), (3), (4) or (5)   $10.00
      Second violation of Section 501 (A) (1), (2), (3), (4) or (5)   $25.00
      Third and each subsequent violation of Section 501 (A) (1), (2), (3), (4) or (5)   $50.00
    2. All violations of Section (A) (6)   $100.00

BE IT FURTHER RESOLVED that this resolution by duly recorded and authenticated by the signature of the Township Clerk, and the Plain Township Board of Trustees shall hereby advise the Clerk to publish same in a newspaper of general circulation within the Township according to the requirements of Ohio Revised Code Section 504.11.
