Home Rule Chapter 1500 - Use of Yard Waste Drop Off Area

BE IT HEREBY RESOLVED by the Plain Township Board of Trustees, Stark County, Ohio, to Amend Resolution #19-489, Home Rule Chapter 1500-Use of Yard Waste Drop Off Area.

WHEREAS, Ohio Revised Code (hereafter ORC) Section 504.04(A)(1) and (2) authorizes the Board of Trustees to exercise powers of local self-government in the Township and to adopt and enforce within the Township local police, sanitary and other similar regulations.

WHEREAS, ORC Section 504.05 authorizes the Plain Township Board of Trustees to impose a civil fine up to $1,000 for the violation of a resolution adopted under ORC Section 504.04 which can be graduated based on previous violations and ORC Section 504.06 requires the adoption of a citation form.

WHEREAS, commercial businesses have been using the Plain Township yard waste drop off area which is limited to NON-COMMERICAL USERS bringing their property’s yard waste to the drop off area.

BE IT RESOLVED THAT, pursuant to the above statutes, the Plain Township Board of Trustees hereby adopt the attached yard waste drop off area use legislation and fines for violations thereof, and further adopt the attached citation form and request the Township Fiscal Officer to publish the attached notice.

Use of Yard Waste Drop Off Area

  1. Only NON-COMMERICAL USERS and Plain Township Residents bringing yard waste from their property can use the designated yard waste drop off area. No commercial businesses, commercially labeled or licensed vehicles or vehicles in excess of 8600 GVW are permitted at the drop off site.
  2. No construction materials, treated wood, dirt, rocks, or plastics can be dropped off at the site. Only biodegradable yard waste will be accepted. Plastic bags used for transport must be separated from the material and disposed of offsite.
  3. No drop off after posted drop off hours of operation as determined by the Board of Trustees, Friday, Saturday, Sunday, and Monday from 8:00 AM – 6:00 PM, and will then close November 30th for the Winter.
  4. Sign(s) shall be posted by Township personnel containing these regulations.
  5. Whoever violates this resolution is subject to a fine of $100 for the first violation and a fine of $500 for each subsequent violation.
  6. Plain Township Residents ONLY. The person picking up the card shall be the owner or spouse of the card and their driver’s license or State ID, shall match their Plain Township address.
  7. The Plain Township Yard Waste Card will cost $25.00 per year. If you lose your yard waste card and need to replace it, there is a $15.00 charge for a new card. Your old card will be deactivated. Additional information regarding the card can be found on the Plain Township website or at Plain Township Hall. Abuse/misuse of the Plain Township Resident Only Yard Waste Card will result in revocation of the yard waste privileges and NO REFUND will be given.
  8. No tree or plant branches larger than six (6”) inches in diameter, and no longer than four (4’) feet.

  10. NO LOGS
  11. NO STUMPS
  12. ABSOLUTELY NO DUMPING OF: PLASTICS, PLASTIC BAGS, LUMBER, PLYWOOD, METAL, GARBAGE, TREATED WOOD, FENCING, STONE OR CONCRETE

When using the site be prepared for your debris to be inspected for rule compliance and to show proof of residency. Enforcement of the rules is key to the sustainability of the site.
